I cannot afford my huge Ohio house any longer so I tried selling it last summer by private reserve auction. The high bidder thinks she "won" even tho she did not meet the reserve and has filed a suit against me, inc. a lis pendens on my property! The trial is not til Feb. and even tho I fell I will surely win I have had to continue payments and am now out of $$. Countrywide will NOT refi me w/ the lis pendens. Is there anything I can do except go into default at this point? The plaintiff is winning by virtue of squeezing me financially and dragging this out w/ continuances, etc. HELP!!

Hi mgrif!

Welcome to forums!

As far as I know, there is a document called "Withdrawl of Notice of Pending Action" which has to be executed by the party who filed the lis pendens and then record it at the the County Recorder's office to remove the recorded Notice. Once the lis pendens is removed, then you will be able to refinance the property.
