My father signed for a home loan for me so I could move down and move him in with me to take care of him..Now he has died, I dont want to lose my house. I pay the pmts and always have but my brother is talking about going through probate court with the estate stuff (just so he can get money) No one knows about my house being in his name. Dad has other house and property.. what can I do My credit isnt good at all

Hi rokn,

If the property is still in your father's name, it will have to go through probate in order to remove his name from the title. The lender may ask you to refinance the property in your name. But given your not-so-good credit, it is not possible for you to refinance. However, I do not think the lender will have any problem if you just keep making the monthly payments on time. If the property is sold after the probate process is over, the loan will have to be paid in full.
