I am divorced. I gave up all equity in my house to my ex wife. The final divorce papers say that she had to refinance by June 30th of 2009 to get my name off of the house. Well she went ahead and did a loan modification in her name only. My name is not on it--she has given me copies of the paperwork. I closed on a house today with my girlfriend. No where on my credit report did it show that I was still attached to the mortgage loan. When she did the loan modification was I removed from the loan and how do I go about getting my name off of the deed in Florida?

Your name should have been removed from title at the time the modification was recorded, this does always happen. You may have contact your divorce atty on how to file a 'Quit Claim' deed or Intra-spousal Transfer deed or a Grant Deed to "grant yourself off title", leaving your Ex on title. A settlement agent or title company would also be of assistance.

Hi aflynn,

I agree with tmtc. I guess, your name was removed from the mortgage during the loan modification. But normally, the lenders prefer refinance to remove a person's name from the loan documents. As far as removing your name from the property deed is concerned, you should sign a quitclaim deed in your ex-wife's name and transfer the property to her. Then she can notarize and record the deed in her name.

Hi aflynn,

Welcome to our forum.

I agree with tmtc & Adonis.

You have to use quite claim deed to transfer the property on your Ex- wife's name & then she will record it in country record then you have to refinance mortgage on her name so you can name off from property . After that your Ex-wife responsible for house ownership & make payments to lender.

You can remove your name from mortage loan. there are two way :

1) You can remove your name by refinance.As for having trouble getting credit ,you can contact to bank and can show you divorce paper that might be help you.

2) A quit claim removes you from the title, so you have no ownership over the mortage and you can transfer whole in your ex- wife name.
