Can a judge order a person to pay the mortgage in stead on child support

i was divorced in 2006, and my ex wife was given the house that she and my 2 sons live in. i was ordered to pay child support until my sons are 18 years of age, which is 5 years for the youngest one. my ex wife is having trouble making the mortgage payment and is now over 30 days behind. we have been to court over 6 times and have a date coming up real soon. the judge has already stated to her she needs to make timely payments on the house, refinance the house in her name only or sell the house. she has stated that she uses the child support to make the house payment while we were in court.

i was thinking that if the judge remove the child support then i will refinance the house in my name, make the payments on the house and my ex wife and sons can live there until the youngest is 18 years old, after that i will sell the house to my ex wife for the value of the loan. can i do that ?

what do you think ?
if court is giving verdict in favor of you then that is OK.but I do not think court will relieve you from the child support if your wife is unemployed.

but even if you are relieved from child support issue then make sure you get it in written format that after 18 yrs of attaining the age,your child will get full control over the property.

honestly, i think what you've suggested has merit, william. i am not convinced, however, that a judge will see it your way. it's worth asking, though - it seems pretty clear to me that you have your son's well-being in mind, and that you're amenable to helping your former wife out at the same time.
