my exwife and i bought a house years ago after the divorce she left the home leavn all responsilbity on me. im maintaining the payment and want to remove her from the loan but she want sign any papers given me full possesion of the home. what can i do?

Hi hog213,

If she wants to remove her name from loan then refinance mortgage on your name & remember that, If you not living together for long term, So sign quit claim deed before refinance mortgage & take home on only yuor name & then refinance mortgage & remove her from loan. Don't forget to inform your attorney before doing anything with property.

i hope you would be able to refinane mortgage alone.

let's go back to the beginning, please.

hog 213 says "but she want sign any papers given me full possesion of the home."

where he wrote "want" we will insert the word "won't" because that's a simple misspelling.

so, it's abundantly clear that he cannot refinance the mortgage because he lacks the cooperation of his former wife. the question is "what can i do?"

obviously, since he cannot refinance the loan, it appears to me that he'll have to go back to court to seek some sort of decision that forces his ex-wife to relinquish the property and allows him to refinance eventually.

please, everyone, if you plan to respond to a post that asks a question, read the post in its entirety so that you can respond with a logical and reasonable answer.
