Hello, I own a home with another party who left in 2006, he refuses to sign over the deed, the property is appraised 190 and note is 240, he won't agree to a short sale and I was in a chap 13 at one point. All areas come back to a new deed needs to be granted so I can refi,sell and such. My boyfriend and I want to get married if I add him to the deed, can we refi and get a new loan and get this guy off. Is the only relief going to be to petition to partition the probate court for a new deed????
Help!

Welcome djunkins,

If you add your boyfriend to the property deed and refinance the loan, then it will remove the other party from the mortgage docs. However, it will not remove him from the property deed. Thus, that person would still remain the owner of the property. When you try to sell off the property, you will have to take his signatures.
