One bro.has did unlawful detainers,evictions,etc. The sis. who resides in the home pays the mortgage, ins everything being spiteful he wants the sis. out and on the streets.On the other hand,both bro names is on the deed the bro.who wants her out has no income in the past 3 yrs.has never paid anything towards the home and is in Federal parole the other bro. has gainful employment for 9 years. The sis. has never been late on any payments. How do the good bro. get the bad bro. out off the mortgage? Embarassed

Welcome to forums!

The good brother needs to refinance the mortgage in his name. Once he does so, the bad brother will not be liable for the mortgage. However, if the bad brother's name is on the property deed, then he needs to sign a quit claim deed and transfer the property to the good brother. Once he does so, he will not be considered as the owner of the property.
