How do i find out who has a lein against my property?

Posted on: 30th Jun, 2009 09:19 pm
I went and applied for a line of credit at my bank and all was great until they told me there was a lien against my property and I dont believe it was my judgement, as the property was quick deeded to me. Is it possible that the dept came with the property or could it be something else. The other thing is the company that holds the lien no longer exists so how do i get it removed to further my bank loan? Please Help
Hi JamieMenchenton,

You can go for a title search and check out who has a lien against your property. You need to get a lien release certificate from the lien holder in order to remove the lien from the property.

You've mentioned that the company which was holding the lien on the property no longer exists. In such a situation, I would suggest you to contact an attorney and discuss your options with him.

I guess, the previous owner has not paid off the lien. As you have now purchased the property, you will be liable to pay off the lien.

you can go to the clerk's office and get a copy of the recorded release

I found out some new information on this whole ordeal, I contacted the county assessor and they show no records of a lien or a judgment against my property but Bank of America still says there is a lien/judgment againt it and I found out that the dept from a credit card(bank) had been bought by Providian, then they were bought by Washington Mutual and now Chase Manhattan has now got it but they have no record of a judgement or lien. How do i get this judgement released if it does not exist on my property? I am confused and dont know what else to do. I really do not want to hire an attorney if i dont have to. Please, i need some advice.
