Social secuirty liens

Posted on: 08th Jun, 2009 10:06 pm
Does anyone know if the government has the right to lien your SS do to restitution. I know they can do it for child support, but I was always told that was the exception. I have a client that says the government is going to take 15% of his monthly payment for a 10 year bank failure that he was a part of. Something smells fishy to me. Any input Thanks
Hi

Social security income is usually immune from the creditors. They cannot garnish your social security checks. But the US Federal Govt. has the right to garnish your social security checks, if court has ordered a restitution against you. But much depends on your individual situation. You need to check with a lawyer whether the Govt. can garnish your client's social security in this particular situation.
