When things were great I bought a house got the mortgage in my name and but my sister on title (she is not on loan). Now there is some major negative stuff....I need to get out from under and want to sell. What do I need to do about my sister on the loan. She has paid "rent" for a while. I file the tax credits as the mortgage is in my name.

whether your sister is having any full time job?What about her credit score.It will surely have some impact on the loan proceedings.

I think these two question's (job and credit score) answers is sufficient for your query.

Sister is working and not sure about her credit score, I would think not in good shape. She is not on the loan and unfortuantely we are not communicating any more. I think I was nuts when i put her on the title when she is not financially responsible. I must sell the house to get out from under the note and away from her. So trying to figure out if it is going to be a legal nightmare or not....thank yoy for replying

Hi Quest,

As your sister is on the title, she legally owns the property. If you want to sell the house, you will have to get the title in your name. You are already on the mortgage and have been making the payments. So, the mortgage company will not have any objection if you get the title in your name. Now, to change the title in your name you will have to get a quit claim deed signed by your sister. She needs to transfer the title to you through the deed so you can sell the property.

Since you are not speaking it will be tough to get her to sign over a quit claim deed.....maybe offering her an incentive will do the trick.
