procedure for transfer property.....

I have construct home near our old house. but problem is that the land is not with my custody. It belongs to other relative. so how can i transfer the home to me?is there any problem if i sell that home because i am not land owner, as land owner is my relative?
what is legal procedure?

Welcome to forums!

You should have first transferred the property in your name and then constructed the home on it. It would have made things easier for you. I guess the home is in your name. So there's no need to transfer the property. However, you may need to transfer the land. I would suggest you to contact a real estate attorney and take his opinion in this regard. Keep the community posted regarding this matter.

Hi sunil..

Better you should try to talk with the relative and pay him for the land amount.So this will solve the problem for the coming years.

One more to add make sure you pay the housing tax for the municipality or any local governing body.It will also help you.

You cannot sell the house before you transfer the land in your name.

Make sure to do that land transfer first.

yes !! So many times the original person who owns the land gives it on lease or long lease (99 yrs) and the house owner builds building on the land.

This is only a contract for 99 yrs

One more interesting stuff in this is we as an individual never owns anything in 'reality'.

We pay the property tax for the purpose of using the property which is owned by government at any circumstance so in this condition landowner is government and house owner is an Individual.
