How difficult is it to sue a lawyer for multiple misinformation about the law during a foreclosure proceeding? Our lawyer stated, all along, that per the law our second mortgage will be wiped out once the foreclosure is finalized. We just found out that is not the case and now have to either bargain with our second morttgage company on forgiving the loan (or drastically reducing the amount owed) or filing bankruptcy. We did sign a contract with the lawyer, but in the contract was stated that opinions stated are only opinions. What she told us regarding the second mortgage was not an opinion but the law -- as she told us. Do we have any recourse with her?

All I want to do is see if I can recover anything for now having to file bankruptcy and having to pay for the cost of it since she told us all along that the second mortgage would go away with the foreclosure. She obviously did not know the law in Wisconsin and misguided us. Do we have any recourse?

Hi Guest,

You can contact an attorney and take the required steps to sue the attorney who gave misinformation to you. However, I don't think you will be able to recover anything.
