My mortgage company has my loan in loss-mitigation, and forgot to apply my Feb 09 money to the server and they me reported to the credit bureau. I have tried to reduce my mortgage because my husband died last year and the loan we got was a preditory loan. I called the investors, they say call the server and the server says they are waiting for a response from the investors. This has been going on for a year. What can I do

did you mean february of 2008 instead of 2009?

i doubt that a lawsuit against your mortgage company would be helpful. i think all you can really do is to keep on plugging, bothering them until they resolve this for you.

oh....well you said it's been going on for over a year...february of 2009 is only 3 months ago. i'm confused.

how can you as a mortgage lender advise YES YOU CAN AND SHOULD SUE as all wise people have noted this result of the real estate disease as it has been addressed by those in the know for several years now. what in the world is that last post, reen?

it's a lovely thing to do a testimonial, but what you've done is placed an advertisement for this lawyer. that's not acceptable per community guidelines, and frankly your credence is limited by the incomprehensible opening line.

With Flagstar bank in loss mitigation. Was approved for loan of 1609 a month which we paid on time for 6 months. Then they lost the paper work we had to re-sign all the paper work again, this time they lowered my mortagage from 1609 to 1553. So i just keep paying the 1609. The next thing that happened was they called and said we missed a payment which we never did. And took us off the loss mitigation program. Now after 8 months they said that we never missed a payment, that is was their fault. But they will not let us back on loss mitigation and are foreclosing on our home in 60 days.Need anyones help please.

Hi Guest,

If it was their fault and if you never missed a payment, then they shouldn't foreclose the property or take any actions against you. I will suggest you to contact an attorney and check out how you can avoid the foreclosure.

You really have to sue them by using your rights. The law can protect you, you have to consult an attorney and get what you deserve.

Attempting to sue isn't necessarily going to do you much good. What you need to do is to defend against what's taking place in this case. They're in the process of suing you (or already did and won a judgment it seems). You need to defend yourselves and move on from that point.

You'll want to have as much documentation as you can possibly find to document that you've never missed a payment.

And you need to act immediately, in case you hadn't known that already.
