My Uncle owned 10 acres and built a house. Twelve years ago he sold the house along with 5 acres and attached a right of first refusal on the selling contract. I have met with our lawyer who transferred the gifted land. The lawyer said several times that we would not be able to get a construction loan with our lovely neighbor on the title. Now I am left with a clouded deed, a potential neighbor that will not sign off and a beautiful piece of natural beauty. Any suggestions on how to get around this. Thanks for any and all the feedback. Help!

Hi

If your neighbour is listed on the title to the property, there's no way you can remove him from there. He can be taken off the deed, only if he agrees to sign a warranty deed and transfers his property share to you. You can buy him out as well i.e. you can pay him a certain amount of money and ask him to sign over the title to you.
