I bought my house in 2004 after I was already divorced. Now that my kids are grown I changed my last name back to my maiden name. How do I update the last name on the title of my house to reflect my maiden name? I am not selling my house to myself so do I need a lawyer to do this? How much would this cost? If I have to pay for a lawyer would this be discremination as men don't have to deal with this kind of issues at all? Thanks!!

Interesting question. I would think that you can file something with the county to update the name on the title. It should not be very difficult or expensive. I would do a search for the clerk of the court in your county and give them a call. They will be able to direct you on how to change the name on title Smile

Hi gwenmm,

I do believe changing your last name on the title should not be a problem for you. You have the documents that prove that you have changed you last name on the property title, right? I think all you need to do is, go to the county clerk’s office and submit the documents. You may have to fill out some sort of form for this. There is no need to engage the service of a lawyer at this point in time. Contact your local county clerk’s office to know more on this.

I emailed a few people last week and this is what I have so far:

1. Email received back from County clerk's office: "You would have to go to a title company and have a new deed drawn up to change the old deed. Once it is filed you cannot change it. But you can re file a new one".

2. Email received back from Title company: "Gwen, thank you for contacting me....I'm concerned that by you deeding the property to yourself for the only reason of changing your last name you may void the title policy and cause a reason for your mortgage company to be alarmed, assuming of course that you do have a mortgage".

I then called the title company and they referred me to the county clerk for more help (hahaha...). Also, of course, my mortgage company has my current last name on file. That was updated with no problem at all!! Not sure why this is relevent.

Am I going somewhere?? please help again. Thank you

By the way, the person I spoke to at the Title company, on 10/27/09, is supposed to call me back about this, but I am a little concern that she didn't know what to do. I am still waiting on a response since last Tuesday. Thanks.
