I have deeded TS & recently missed making mtnce pmt on due date...can the title company foreclose immediately or is there a time line before legal & collection precedures can be implemented

Florida TS...Billing was Jan 1, 2010 due on receipt...45 days from Billing $25 Fee...75 days from billing interest...& interest thereon if further delinquent...can the the title company foreclose immediately...is there a time line before legal action can be taken

Hi glucyk!

Welcome to forums!

It will be the discretion of the title company as to when they would foreclose your property. However, it is true that the title company can take legal actions against you if you do not pay the maintenance fees on time. The title company can even place a lien on your property and it will have a negative affect on your credit report.

Title company was aware that a sale had been made of the property by their own agent and maintenance pmt was to be deducted from sale proceed and they still went ahead with collection resulting in collection fees on each week...on realizing what had happened the sellers closing stmt was revised 7 days later to reflect the deletion of the collection fee
on 2 of the 3 weeks...I feel this is not right as it was their communication mistake...where do I go from here?...do not want to fight with the collection agent...

Hi giselelucyk,

I would suggest you to contact a real estate attorney and take his opinion in this regard. He would go through the whole matter and let you know what steps you need to take.
