My name is not on the mortgage loan, but it is on the deed. My husband and I have been separated for 5 years now-I would like to move, but he doesn't want the house. He said he will let it go into foreclosure. I do not want this to affect me-should I do a quit claim deed so the mortgage company will not come after me?

Hi Isber,

A quitclaim deed will remove your name from the property deed. As your name is not on the mortgage but on the deed, you can simply use it to remove your name from the deed and get rid of all liabilities toward the property.
