My ex and I brought a house, he abandon property and has now filed for bankruptcy. How do I go about taking his name off of deed? Do I need to refinance to get his name off. Please Advise

If you are both on the loan, then the only way to get a party off the loan is to refinance or sell. If you are only person on loan, but ex is on title with you, you can file the quitclaim deed with his consent and signature. This will remove him from ownership of the home. Unfortunately, the lenders will not remove a party from mortgage note...

Hi cjones!

Welcome to forums!

You will have to ask him to sign a quitclaim deed and transfer the property to you and then you need to refinance it to remove his name from the mortgage. However, if he has already filed bankruptcy, then he may not be able to transfer the property to you.

Hello cjones,

Once recorded the death certificate will notify the world that you are the surviving owner of the property. A new deed is not required. If you wish to have a new deed in your name alone you should contact an attorney who specializes in real estate law.

he can sign the home over to you......
refinancing will do it too.... but he would have to come to closing and sign off on it then as well.
