Quitclaim deed - is this the best option

I co-signed a mortgage loan for my daughter in 2008. Since then her hours were cut and she has gone through great financial difficulty and I have paid the mortage more or less the past couple of years. My daughter agrees tht she needs to remove her name & bad credit from this property and hand it over to me so that I can refinance. I am paying two mortgages at this point. What is the best route to take my daughters name off of the property? She received a tax credit refund for purchasing a property in 2008. What will happen with tax rebate that must be paid back over the next 15 years? Will this become automatically due? She does not have the resources to pay for this. Can this be declared in bankruptcy if she were to do so?

Hi fkwillette,

You should ask your daughter to sign a quitclaim deed in order to remove her name from the property deed. Once her name is removed from the property deed, then you will be able to refinance the mortgage in your name.
