Spouse awarded home in divorce. Property was properly Quit Claimed to her prior to husband filing BK. She is on title/he still on loan. She cannot qualify for re-fi & non-assumable so, she wants to Quit Claim it back to her ex, who will bring current. Would he, through this transfer and in spite of his BK be able to then negotiate with the lender for a modification of terms, principal etc...? Would there be any negative implications to them by doing this?

Hi Ms.T!

Welcome to forums!

As the ex-spouse has filed bankruptcy, it might be a bit difficult for him to qualify for a mortgage with lower rates and terms. Nevertheless, he should contact the lender and take his opinion in this matter. The lender will be able to let him know whether or not he will get reduced rates and terms.

Feel free to ask if you've further queries.
