A family member would like to do a quit claim on property that is in chapter 13 bankrupty. My husband and I would like to have this house out of our name. In the event of our deaths we have a will where this family would inherit the property. Can you give us some legal directions. Thanks, ASW.

Hi adelewoods,

If you have filed bankruptcy, then it is not the proper time to transfer the property to someone else through a quitclaim deed. You should wait till the bankruptcy is discharged and then take steps to transfer the property.
