If you are the heir to the property, then you need to file an affidavit of heirship at the county recorder's office in order to get the property transferred in your name from the deceased person's name.

Thanks Sussane........ There is a will from the deceased person. We need probate on the will. But other than the probate, do we need any kind deed to convey?

Sussane, One of my friend has a mortgage under her name, but she has her two sons to joint on the deed. When she sells the property, who should sign off the Deed of Trust? Should my friend sign on the deed of trust only or my friend and her two sons?

Hi Lily,

As far as your first query is concerned, I don't think you will need any other deed. Nevertheless, it will be better if you could have a word with a real estate attorney.

As far as your second query is concerned, your friend as well as her two sons need to sign the property deed while selling off the property.

I understand my friend and her two sons need to sign the deed when she sells her property. Who should sign the deed of trust? My friend signs the deed of trust only or my friend and her two sons sign the deed of trust.
