i wish to transfer property in my brothers name.

Like 0 Dislike 0 i have a property in my name and my mother, she passed away in 2008. but my brother lives in the property and has been paying the mortgage. how do i transfer the house to him without changing mortgage. which deed can be used to say that once the mortgage has been paid, the property will be his.

As far as your mother's share is concerned, he needs to file an affidavit of heirship at the county recorder's office and get the property transferred in his name. However, the lender will ask your brother to refinance the mortgage after the property transfer takes place. Thanks
