Hello My husbands father passed away 2 years ago, the estate has closed but is in heir ship. Is it legal for my husband to remove some of the junk and clean up the property? His sister is not talking to him or his brother his brother says it is ok but we do not want his sister to be able to come back and do anything that would get my husband in trouble. Thanks

Welcome Guest,

As the estate is still in heirship, it will be better if your husband can take permission from the other heirs and then take a decision in this regard. He may even contact an attorney and take his opinion in this matter.

So many of these situations scream for a lawyer's assistance. Adonis is right - consult with an attorney and make sure it's okay to do the cleanup that's necessary. You're smart to be cautious.
