Hi, my husband and his mother own our home jointly, both of their names are on the deed we are wanting to remove his mothers name from the deed and add mine. we are also still paying on the morgage. is a quitclaim deed form the way for us to go. and since the loan is in both names will that effect us also?

Welcome Guest,

Your husband's mother can use a quitclaim deed and transfer the property to you. This will make you the owner of the property. As far as the loan is concerned, in order to remove his mother's name from the loan, you and your husband can refinance it.
