My mother in laws house is paid for and she wants to record a quit claim deed that has both of their names on it just in case something happens to her so he wont have to do anything in case she dies.

On the quit claim deed, should it be her name AND his or her name OR his?

Hi Michele,

The quitclaim deed should mention your mother-in-law's name AND your husband's name. A real estate attorney will further guide them in this regard. After your mother-in-law's death, your husband will have to file an affidavit of heirship at the county recorder's office and get the property transferred in his name.
