Hi donna,

It will be better if you could buy the property after your divorce is legally finalized. Nevertheless, in order to take the best decision, you can contact a real estate attorney and take his opinion. Depending upon your state laws, he will be able to let you know whether or not your ex needs to quitclaim a deed if you buy a property now.

Thanks
