My 88 yr old dad has owned his home (PIF) for over 40 years. He remarried 35 yrs ago. His present wife is permanently living in a care facility because of advanced Alzheimers. My dad is now seriously ill and I am wondering if he can do a quit claim deed to one of his children or all of them? Does his wife have to sign, too, though I am quite sure her name was never on the title, since he owned it prior to their marriage.

Hi Waldemarce,

It will be your father's discretion whether or not he will quitclaim the property to one of his children or to all his children. If the wife's name is not mentioned in the property deed as one of the owners, then she won't have to sign the deed.
