Mother leaves property to 4 children through a Waranty Deed Reseving Life Estates. One child may need to claim bankruptcy, can they go after his portion of the property? Mother is still living.

Hi Ray!

Welcome to forums!

The child who is filing bankruptcy will have to list the property as one of his assets. The bankruptcy court will let him know whether or not they will go after the property or it will be considered as an exempted asset. The child who is filing bankruptcy should contact the bankruptcy attorney in this regard and take his/her opinion.

Feel free to ask if you've further queries.
