My husband is really having trouble with his family members his mother has diagnosed dementia and 2 siblings have power of attorney over her affairs but her and her ex-husband have a life estate and deeded the property to him. But the daughters moved the mother out, cancelled all utilities, took most of the belongings. When my husband found out he changed the locks, now he has a trailer on this piece of property with his mothers house. His sister has gotten a quitclaim deed to the ex husbands life estate and has served My husband with papers to charge him a fee to live on the property is this legal. and what rights do he have in this situation.

Hi felecia,

If the property deed mentions your husband's name on it, then he will be able to claim ownership of that property and won't have to pay any charges to live on that property. However, if the sisters are the sole owners of the property, i.e. if their names are mentioned on the property deed, then your husband won't have any legal rights on that property and they can charge him a fee for that.

Thanks
