i live in ri i have recently gotten a divorce my ex and i have a deal in place i can keep the home if i can modify it and i wont touch his retirement, i was wondering if he will have to sign a quit claim deed (he says he wont unless it is needed for a modification of the loan) and if he dont what will happen when and if i sell the home will he be entitled to half of the sale for not signing a q.d. after i have been paying for it and even came up with the money to get property out of foreclosure.i had to borrow from family and feel if i sell they should get their money back before he gets anything from the sale. any help would be great thank you

Hi mjom,

Unless your ex signs a quitclaim deed, you won't become the sole owner of the property. Unless you become the sole owner of the property, you won't be able to sell it off. You will have to convince your ex to sign over the quitclaim deed. You can even offer him some money to sign the deed.
