I signed a quit claim deed to my ex with the stipulation that he would refinance the house and get my name off the deed. It has been 6 months and he has not kept his word. It was also recorded in the contract with the lawyer that this would be done. Can I make the quit claim null and void or is there any repercution I can take for him not doing his part?

Hi turnerloose!

Welcome to forums!

You cannot make the quitclaim deed null and void. You can ask your ex to sign a quitclaim deed and transfer the property to you. This will make you the owner of the property again. If he does not do so, then you can file a lawsuit against him so that the court can force him to refinance the mortgage in his name.

Feel free to ask if you've further queries.
