Hello Everybody.

My friend James Orr is Living in Los Angels from 5 Years.
He had married 2 Years ago with this lover. Now they divorced.

When they both married my friend take new home in New Jersey in his wife name & he is co-signer for the mortgage. My friend paid 50 % of the loan amount to the mortgage company.

When they divorced they living in same city, She married with another guy. But she passed few days ago in Car accident.

Her still husband is demanding for her named house my friend not used quit claim deed on right time. Her Ex Husband fights for to get beneficiary for property of hes passed wife.
But this home in on the name of passed Ex wife she who never ask for home ownership to my friend. She is a good women. Her ex husband troubling to my friend for property.

When she die, She is wife of another person who fights for her property.

How can my friend stop him?

Give me solution for this problem please. Till date my friend is in desperation please help me.

What we can do to give justice to my friend ?

I hope you will help me.

Hi Daniel,

Welcome to our forum.

I feeling glad to help you, So i would like to advice you that if he wants to stop her ex wife's husband he need to give proof of court & need to use Quit Claim Deed. Your friend must primary loan holder & he having full ownership of his property & must having divorce proof.

Your friend is real owner of your property so her husband can't get easily ownership of property. In view of onside his husband is legally demanding for beneficiary but this is not a fair.

If he Troubling to your friend he can take him in court & he can take legally action on him to save his own paid property.

Hi daniel,

What I understand is that your ex-wife's husband is claiming an interest in the property which you and your ex-wife purchased. Right? Well, since you have mentioned the title is in your ex-wife's name, you need to remove her from there and change it to your name. Since she did not sign any quitclaim deed prior to her death and has left no will, you should file an affidavit of heirship with the probate court along with her death certificate and proof of your marriage. This will transfer the title in your name.
