can i claim half the property?

My ex husband and i bought 25% of a property from his army redundancy money and rented the other 75% of a housing association. my husband and i divorced in 2005. am i entitled to half of the 25% we bought. my name is still on the property with my ex husband. if i am entitled how to i go about claiming my share?

Hi kazwalton!

Welcome to forums!

If your name is on the property deed, then you can definitely claim a portion of the property. The division of the property will be mentioned in your divorce decree. You should contact your divorce attorney and discuss about claiming the portion of a property as a part of your divorce settlement.

thank you for your reply. on my divorce document it says " any property which, or an interest in which, is devised or bequeathed to the former spouse shall pass as if the former spouse had died on the date on which the marriage is dissolved unless a contrary intention appears on the will.
I am not sure what this means. can you help me with this matter please.

Hi karen,

In my opinion, it means that you would receive the property after your divorce settlement. However, it would be better if you could contact an attorney and he can help you in understanding the statement in divorce decree properly.
