I have stated in my other posts that my name was put on a quit claim deed along with a lady (who I do not know) but she is deceased. I already know that I'm only getting half the interest as the house and property was auctioned off to pay back taxes. But there isn't a clear title on it since myself and the other lady is named on the quit claim deed. Ok my question now is Once I receive the interest from the property will I still have anything to do with the title? In otherwords the home and property doesn't have a clear title on it.

Peejo, does the deceased lady has any relatives? If she has then they can claim ownership of her share of property. Distribution of her property will then be decided as per laws of intestate succession applicable in your state.

Yes the other lady who is on the quit claim deed among with myself has a grandson. They told me at the county clerks office in Fla. that he would be entitled to her half of the interest. He did submit a claim but was denied because he didn't have proper documentation. I did send in proper documentation. I live in Ky but the property that was auctioned off was in Fla. I hope that my claim isn't denied as I did have it notarized like stated and sent in everything that was asked. Since my dad didn't give me anything in his will, I hope that doesn't have anything to do with this quit claim deed. I did have a lawyer call me and say that I had money coming to me because my dad had spoke to him back in 1982 about putting my name down to receive interest once he passed away. He didn't make his will till 2002. I'm still assuming the two would be separate. Especially since several people have contacted me about money that I have coming. This whole thing is confusing me more each day.

As you had taken proper steps your claim was accepted. Will is not related to the quit claim deed he made to give you half ownership. After the deed was made out you received your ownership share.

The will is being used to distribute rest of his property and cannot affect the ownership he had already transferred before making the will.

Hi Peejo,

Welcome to our community.

You can go for a title search which will reveal if there is any defect on it. And then you can proceed further to remove the defect or clear the title from any lien.

Since you have a lot of people contacting you for the money, it gives me the feeling that you will be getting your share of interest. And, since your have sent in a proper documentation, I think I will help you in getting what you deserve from your father's property.

I understand it is quite confusing for you but don't worry. Till now things seem to be in order. By the way, when are they going to inform you about your getting the interest in property?

Hi Jessica,
I called the county attorneys office last Friday and the lady I spoke to is suppose to get back with me on the claim form I sent to them. I haven't heard anything today from her. The claim form has been there since April 27th and I was told by the county clerks office that the county attorney was slow and it could take up to 2 months before I receive my check. I'm going to call them again this Friday and see if I can find anything else out. I wish they would hurry it up though. There are still other issues I want to check on like the attorney that was the first to try and find me and was all estatic when he did and I've trying to figure out how he fits in the equation. I'm waiting to receive my money first and then call that attorney and my dads attorney to find out WHY nobody tried to contact me. Time will tell looks like.

Peejo, I was just reading what you have gone through and I feel so far you've done the most you could do. Now, you need to wait till you get the check and then you can proceed further to deal with the attorneys.
