my husband passed away. Do I take his name off of the deed to our property and put my daughters on...Our deed is in my husband's name and my name. He just passed away, so do I take his name off and put my daughters name on with me or just leave it as is

You can do either - it is your choice as his passing probably left the home to you Unless there was something different set up before his death.

Hi jmiller!

As the property has your name on it, you can leave it as it is. However, you can also add your daughter's name on it if you wish too. I think you can use a quitclaim deed. But for doing that your daughter has to be an adult (i.e. 18 years old).

my brother bought the house with my dad and my mums name was on the deeds when my dad died he got my mum to take her name off without us knowing what can i do about this mum was on depresent tablets has been for years dont think she was in right frame of mind when doing this

Hi shaz,

As your father is deceased now, then you and your mother can file an affidavit of heirship at the local county recorder's office and get the property transferred in your names.
