My mother passed away last year. My younger brother is the executor of the will. The will states that her assets including her house be divided equally amongs the kids. My brother does not want to move, he wants the house but doesn't want to give anyone any money.

The house still has a mortgage on it.

How long can the mortgage stay in my mom's name after her death?

Hi juniorlee!

Welcome to forums!

As far as I know, there is no time period as such for the mortgage to stay in your mom's name after her death. The heirs should inform the lender about the death and try to refinance the loan in their name. This will help the heirs to save the property.

Feel free to ask if you've further queries.
