HELLO:
I purchased a home before I was married. After I was married I refinanced it, but only in my name. They had my husband sign a deed of trust. We are divorced now and I kept the home. When I go to sell this house, will there be an issue. I did a search and no warranty deed was every filed?

thanks

If he in NOT on title to the property, and he is not on the loan then you are ok to refi or sell. If he is on title, then you would either need to have a quitclaim prepared before you sell, or have escrow complete the deed while you sell.

Hi DawnCrowell!

Welcome to forums!

If your husband's name is not mentioned on the property deed, then you won't face any issues in selling it off. You won't have to take his permission in selling off the property.

Feel free to ask if you've further queries.
