I Filed for divorce on this December 2, 1996. My ex Wife give up, relinquishes and waves and rights to equitable distribution of the same and shall execute now or in the future all deeds and other documents necessary to convery total ownership to Husband. Now at this time she is still on the deed how do i removing her name

Hi Bigdog,

Welcome to Mortgagefit discussion board.

You can ask her to sign a quit claim deed to remove her name from the deed. On the deed she will be named as the grantor and you as grantee. After the deed is made, get it notarized and recorded to complete the transfer of ownership over in your name.

I agree with Blue, you need to ask your ex to transfer her ownership rights to you using a property transfer deed such as quit claim deed or a warranty deed. If their is no lien on the property then a warranty deed can be used but if there is still any lien like a mortgage then a quit claim deed will have to be used.

my husband signed a quitclaim deed about 7 years ago. we are divorcing, I have an appointment with my attourney next week. My husband says that the deed doesn't mean anything that he is still entitled to his share of the house. I live in TN. Is he right?

Welcome to forums.

If your husband has signed a quitclaim deed to remove his name off the title, then he isn't entitled to any share of the house. I hope you have the deed recorded.
