Can I quit claim my mothers deed to her house to another person other than myself as she is in severe alzheimers and I am her power of attorney. And I do not want the nursing home to use her home as qulateral. Also.. I am the only child so there are no siblings or living relatives involved in this

Which type of POA you have? If it is Durable POA, then you can take legal decisions on behalf of your mother.

You can read more about the effective rights you get by having a DPOA from this page: http://www.oag.state.ny.us/seniors/pwrat.html

Hi Linda,

If your mother goes to nursing home and you are able to pay off the bills, then the nursing home cannot place a lien on her house.

And if she quitclaim her property to other person, then the nursing home can place a lien on her other personal assets to recover the bills, provided they are unpaid.
