Situation is:
My friend has some property like home,Land.but some property has his ex-wife name . He want to transfer this property from her name to his name. when he ask for this to her she refuses.
For this situation he can go throuth the court ?
Or any other way to transfer property from her name.??
There are two things your friend can do. Your friend can either buy out his ex-wife. He can offer a certain amount to his ex-wife and ask her to transfer the property to him. If she is not ready to do so, then your friend can file a partition law suit. The court will look into the matter and pass a judgment to sell off the property. Once the property is sold off, the sale proceeds will be used to pay off the mortgage. Assuming he has a divorce judgment awarding him the property, he can go to court and get an order. Then, record the order in the county recorder's office.
