I am the only living heir to my mom"s house in the will. We live there. The roof is leaking and our Homeowners insurance is still in her name and paid for a year. Homeowners says if we file a claim the check will be sent to her. They say the house has to be in our name. How do we do that?

Hi tnauntbee,

As your mother has left a will, it needs to be probated first. Once the will is probated, you'll have to record it at the county recorder's office and transfer the property in your name. Once the property is transferred to your name, you can then change the homeowner's insurance in your name. After this, you can receive the check in your name.
