Just want to ask if a house that is going through probate court by the repersentative of my mothers estate can do a quick claim deed? See I took care of my mother for the last four years of her life she lived downstairs and I lived upstairs so I could take care of her. My mother did have a will that says something about being divided between my two brothers and the repersentative of her estate which they all own their own homes they each get 1/4 and myself and my twin sons each get 1/12 of it but the repersentative says we have to be out of my moms house by the end of this month. There is some leans on this house but both my brothers said that they would rather have it sold and me and my sons out on the streets. can I do a quick claim deed? Confused Confused

I meant to say that both my brothers would rather me and my son stay in our mother/ grandmothers house but the repersentative would rather sell the house and us out on the streets

My mother had passed away last november and I live in the house see I took care of my mother for 3 1/2 years before she passed I live upstairs and my son and his wife and grandsons live downstairs . My mom did have a will that states that my two brothers and the repersentative of her estate each get 1/4 and myself and my twin sons each get 1/12.My brothers and the repersentative each have there own homes so my brothers said they would rather me stay in the home then sell it but the repersentative wants to sell it so she doesn't have to deal with it anymore. so can I do a quick claim deed? Sad Confused

Welcome to forums!

Unless the probate is complete, I don't think it will be legal to quitclaim the property. Nevertheless, to be on the safer side, it will be a better option to contact the attorney who is helping you with the probate and take his opinion in this matter.

Why not? There isn't any problem with it. You may get a good deal on it as well. You should get a clean title with the closing and everything will work well.
