My husband passed away a little over a year ago. By law, do I have to have his name removed from the mortgage?
Hi suzpet,

It is better to remove your husband's name from the mortgage docs. In order to remove his name, you will have to refinance the mortgage in your name. Once you do so, you would become solely responsible for the loan.

my husband passed away 2months ago. the house has my name on the deedof trust but not the loan what do i need to do get the house in my name?

Hi Guest,

You will have to refinance the mortgage or assume the loan in order to get the mortgage transferred in your name. If you want to remove your deceased husband from the property deed, it will be better if you could file an affidavit of heirship at the county recorder's office. If he has left a will, then you will have to probate the will.

My father passed a little over 2 months ago with a mortgage loan that was only in his name and not my mothers. There is 8 yrs left on the loan. Do we need to notify the bank or can we just continue to pay it off or will this cause problems in the long run?

Hi Phyllis,

There may be problems in the long run if you don't inform the lender about your father's death. I will suggest you to inform your lender about your father's death and then try to assume the loan so that you can pay off the loan without any hassles.
