My mother wants to leave her home, with the remaining mortgage and an unpaid sewer betterment fee, equally to four adult children after her death. How do we avoid probate and inherit the house?

Hi Matt,

To avoid the probate process, she can transfer her share in the property to all four of you using a quit claim deed. It can transfer the ownership straightaway from your mother to you. Thus ownership can be transferred within her lifetime, liminating the expensive and lenthy probate process. She can also opt for a lady bird deed which will help her retain a life estate for herself.

Welcome to forums!

You should get your name on the property deed and then refinance the mortgage in order to transfer it in your name. If you wish to save the property, then you will have to pay off the mortgage dues on time.
