Mother-in-law is not paying taxes on life estate property. Can we take it back from her?

My husband inherited 11 acres of land, but my mother-in-law has use of it for her life. She has not been paying the taxes. Can we take the property from her so that it doesn't get sold at auction?

Hi Guest,

Your mother-in-law can sign a quitclaim deed and transfer the property to your husband. He will have to pay off the property taxes in full in order to save the property from any kind of lien or foreclosure sale.

The life estate holder has a duty to pay the property taxes. As the "remainder beneficiary" you can pay the taxes and make a claim for "contribution" from the life estate holder. A judgment might be able to be collected on the property. check with a local attorney.
