Parent left house to 3 of us siblings. One sibling has stated to my other sib. that he is moving into the house as of a certain date and paying rent. He has not contacted me, nor asked about how much rent to pay. How can he do this? What are my rights? Thank you.

Hi MJPignato!

Welcome to forums!

If all 3 of you have inherited the property from your parents, then all of you are the owners of the property. Neither of the siblings will need any permission to get into the house neither will they have to pay rent for living in it. However, if the property deed has any special clause stating this, then it would be a different issue. Contact a real estate attorney and check out what rights you have and then you can accordingly take steps.

Feel free to ask if you have further queries.

Hi edgar,

If you've purchased the property and if it is in your name, then you're the sole owner of the property. If you've mentioned the name of your daughter's husband in the property deed, then he would be considered as one of the owners of the property.

Thanks
heidi

Hi heidi!

Welcome to forums!

I hope you're not filing bankruptcy jointly with your sister. In such a situation, your sister's bankruptcy filing will not affect you. However, if the property is included in the bankruptcy filing, there are chances that you'll lose the property.

Feel free to ask if you've further queries.
