my dad recently passed away. my mom is planning on setting up a lady bird deed with me (her daughter). We live in Florida. Will this affect medicaid if she every needs it? Are there any other problems with this deed that we should know about? Will we have problems with the title company when my mom passes? Can medicaid take her house if she happens to pass away in a nursing home under medicaid?

Welcome to forums!

Using ladybird will not make your mother ineligible for Medicaid if she expresses her "intent to return" home after she is taken to nursing home. She can express her intent to return home in a letter signed by her or through affidavit. If she doesn't intent to return, the property can still be considered as an exempt asset for Medicaid as long as a relative occupies it when she is not around.
