My father & mom build a home in PR.My mom pass now and he has a new wife. My father want to write a will to say she could stay in that house in PR.Is that legal or the house belongs to my 3 brothers and my self.Or what?

Hi gaudiffred,

If your father is a co-owner of that property, then he can draft a will and transfer his portion of the property to his new wife. However, as far as your mother's portion of the property is concerned, you and your siblings can file an affidavit of heirship and transfer it in your name. But before taking any step, have a word with a real estate attorney.

Thanks
