the mortgage was in my husbands name he passed away and now the mortgage company served me foreclosure papers. I have been to probate and we had joint tenants with right of survivorship. am I going to be held responsible for the mortgage?
yes. since now you are owner of property.

scwife, since you and he were joint owners, you and he also should have been joint borrowers on the mortgage (though it's possible you weren't). your mortgage company is correct in asking you for payment on the mortgage - did your husband have a will that might protect you from losing the home? can you begin making payments so as to avoid the foreclosure?
